General Terms and Conditions of Sale and Use
of the Symphoniya.com Online Shop

The present general terms and conditions of sale and use (hereinafter the T&Cs) apply to any order placed on the online shop available at
https://symphoniya.com (hereinafter the Site).

By confirming an order on the Site, the customer declares that they have read and unreservedly accepted these T&Cs.

1. Identity of the seller

2. Scope

These Terms and Conditions govern the sale, by Association Culturelle Symphoniya, of products and services offered on the Site, including in particular:

  • musical content (audio and/or video recordings);
  • scores and musical documents (digital files);
  • tickets or registrations for concerts, workshops or events;
  • donations or support contributions to the Association.

They apply to any order placed by a customer, whether domiciled in Switzerland or abroad, subject to any mandatory provisions of the law of the customer’s country of residence.

3. Products and digital content

The products offered on the Site are described with the greatest possible care. Photographs, audio or video excerpts, texts and illustrations are for information purposes only and do not constitute contractual elements.

Symphoniya reserves the right to modify the product offering at any time, without affecting orders that have already been confirmed.

In the event of an exceptional unavailability of a product after the order has been confirmed, the customer will be informed by e-mail and will be offered either a refund or a replacement product, by mutual agreement.

4. Prices

The prices of the products are indicated in Swiss francs (CHF) and, where applicable, in euros (EUR).

Association Culturelle Symphoniya is not subject to value added tax (VAT); consequently, no VAT is charged to the customer.

Any additional fees (for example bank charges, currency conversion commissions) remain at the customer’s expense.

Symphoniya reserves the right to change its prices at any time. The applicable price is the one in force at the time the order is confirmed by the customer.

5. Orders

The customer selects the products they wish to purchase and adds them to their virtual basket. At any time, they may check the content of the basket and modify their selection.

To confirm the order, the customer must:

  • provide the requested information (contact details, e-mail, etc.);
  • choose a method of payment;
  • accept these Terms and Conditions by ticking the corresponding box;
  • confirm the order and proceed to payment.

The order is deemed firm and final after the payment has been validated by the payment service provider and the confirmation e-mail has been sent to the customer.

Symphoniya reserves the right to refuse any order for legitimate reasons (for example, suspicion of fraud, payment issues, manifest abuse).

6. Payment

Payment for orders is made online, at the time of the order, via a secure payment service provider.

The accepted means of payment are indicated on the Site at the time of the order (for example: credit cards, debit cards, online payment services).

Payment data is processed directly by the payment service provider and is not known to Symphoniya.

The order is only processed after the payment has been validated by the relevant provider.

7. Delivery of digital content and tickets

For digital products (recordings, scores, videos, documents):

  • access to downloading or viewing is, in principle, provided immediately after payment has been validated, via a download link or confirmation e-mail;
  • the customer is responsible for keeping this link and/or the downloaded files on an appropriate storage medium.

For tickets or registrations for events:

  • the order confirmation serves as proof of registration;
  • additional information (location, schedule, practical details) may be sent by e-mail.

Symphoniya cannot be held liable if the customer provides an incorrect e-mail address or does not check their messages.

8. Intellectual property and licence of use

All works, recordings, scores, videos, texts, images and, more generally, any content offered on the Site are protected by copyright and remain the exclusive property of their authors and right holders.

The purchase of a digital product or a score grants the customer a strictly personal, non-exclusive and non-transferable right of use, for private use only.

The following are strictly prohibited, unless prior written authorisation has been obtained from Symphoniya:

  • reproduction, distribution or public making available of the works, in whole or in part, for commercial or promotional purposes;
  • sharing of purchased digital files with third parties (including by e-mail, messaging services, file-sharing platforms);
  • unauthorised recording, capture or broadcasting of concerts, events or workshops.

Any use that goes beyond this framework must be subject to a specific written agreement (for example for a public performance, pedagogical or professional use).

9. Right of withdrawal and refund policy

9.1. Downloadable digital content

By confirming the purchase of downloadable digital content (audio file, video, score, document), the customer acknowledges that they obtain immediate access to the content and agrees that performance begins without delay.

As a result, and to the extent permitted by applicable mandatory law, the customer waives any right of withdrawal once downloading or access to the content has started.

9.2. Events, concerts and workshops

Tickets or registrations for events (concerts, workshops, etc.) are in principle neither refunded nor exchanged. In the event of cancellation of the event by the organiser, the refund or rescheduling arrangements will be communicated to the customer.

9.3. Physical products (where applicable)

If Symphoniya offers physical products (for example CDs, printed scores), the conditions for returns and refunds will be specified on the product page and/or during the ordering process.

9.4. Specific requests

In the event of a proven technical issue (defective file, non-functioning download link), Symphoniya undertakes to provide the customer, as far as possible, with a new download link or a corrected file. If this proves impossible, a refund may be considered on a case-by-case basis.

10. Donations and support contributions

The Site may offer the customer the possibility to make donations or support contributions to Association Culturelle Symphoniya.

Unless expressly stated otherwise, such donations do not entitle the donor to the provision of a specific good or service in return. They are in principle neither refundable nor exchangeable.

The customer is invited, where applicable, to verify the conditions for any possible tax deductions directly with the competent tax authority.

11. Personal data

Personal data collected when using the Site or placing an order (name, first name, contact details, e-mail, billing data, etc.) is processed by Symphoniya in accordance with the applicable legislation on data protection.

The purposes of processing, legal basis, retention periods and the customer’s rights with regard to their data are described in Symphoniya’s Privacy Policy, available on the Site.

By placing an order, the customer declares that they have read this Privacy Policy.

12. Liability

Symphoniya makes every effort to ensure access to the Site and the provision of products under the best possible conditions.

However, Symphoniya cannot be held liable in the following cases:

  • temporary interruptions of the Site for maintenance, updates or technical reasons;
  • failure or malfunction attributable to the Internet network, access providers, or to the customer’s equipment or software;
  • loss of data or damage resulting from improper use of downloaded content or information provided.

In any event, Symphoniya’s liability is limited to the amount actually paid by the customer for the product concerned, unless otherwise required by mandatory law.

13. Force majeure

Symphoniya cannot be held liable for any delay or failure to perform resulting from a case of force majeure within the meaning of Swiss law, in particular in the event of unforeseeable and irresistible external events making performance of the service impossible.

14. Amendments to the Terms and Conditions

Symphoniya reserves the right to amend these Terms and Conditions at any time.

The Terms and Conditions applicable are those in force at the time the order is placed by the customer. Any new version will be published on the Site with the corresponding date of update.

15. Applicable law and jurisdiction

These Terms and Conditions are governed by substantive Swiss law, to the exclusion of its conflict-of-law rules.

Association Culturelle Symphoniya has its registered office in Les Charbonnières (Vallée de Joux, commune of Le Lieu, district of Jura-Nord vaudois, canton of Vaud).

In the event of a dispute and failing an amicable settlement, the place of jurisdiction is the registered office of the Association; the courts with subject-matter jurisdiction of the district of Broye and Nord Vaudois, in Yverdon-les-Bains (VD), have exclusive jurisdiction, subject to mandatory provisions to the contrary, in particular those relating to consumer protection.
