General Terms of Sale and Use

These general terms of sale and use (hereinafter “GTS”) apply to any order placed on the symphoniya.com site (hereinafter “the Site”). By validating an order on the Site, the customer declares that they have read and accepted these GTS without reservation.

1. Identity of the seller

2. Scope

These GTS govern the sale, by the Association Culturelle Symphoniya, of products and services offered on the Site, in particular:

  • musical content (audio and/or video recordings);
  • scores and musical documents (digital files);
  • subscription to the Salon d’écoute (online listening service);
  • tickets or registrations for concerts, workshops or events;
  • donations or support contributions to the Association.

Professional uses of the works (professional licence) are governed by specific contractual terms, distinct from these GTS.

They apply to any order placed by a customer, whether domiciled in Switzerland or abroad, subject to any mandatory provisions of the law of the customer’s country of residence.

3. Products, digital content and services

The products and services offered on the Site are described with the greatest care. The photographs, excerpts, texts and illustrations are nonetheless indicative only and do not fall within the contractual scope.

Symphoniya reserves the right to modify the offer at any time, without effect on orders already validated.

In the event of the exceptional unavailability of a product after validation of the order, the customer will be informed by email and offered either a refund or a replacement product, by mutual agreement.

4. Prices

Prices are indicated in Swiss francs (CHF) and, where applicable, in euros (EUR).

The Association Culturelle Symphoniya is not subject to VAT; consequently, no value added tax (VAT) is charged to the customer.

Any additional costs (for example bank charges, currency conversion fees) remain the responsibility of the customer.

Symphoniya reserves the right to modify its prices at any time. The applicable price is the one in force at the time the customer validates the order.

5. Order

The customer selects the products they wish to acquire and adds them to their basket. At any time, they may check the contents of their basket and modify their selection.

To validate their order, the customer must: provide the requested information (contact details, email, etc.); choose a payment method; accept these GTS by ticking the box provided for that purpose; confirm their order and proceed to payment.

The order is deemed firm and final after validation of the payment by the payment provider and the sending of a confirmation email to the customer.

Symphoniya reserves the right to refuse any order for legitimate reasons (for example, suspicion of fraud, payment problem, manifest abuse).

6. Payment

Payment for orders is made online, at the time of the order, through a secure payment provider.

The accepted means of payment are indicated on the Site at the time of the order. Payment data is processed directly by the payment provider and is not known to Symphoniya. The order is taken into account only after validation of the payment by the provider concerned.

7. Delivery, access and subscription

For digital products (recordings, scores, videos, documents): access to the download or viewing is, in principle, provided immediately after validation of the payment, via a download link or a confirmation email; the customer is responsible for keeping this link and/or the downloaded files on an appropriate medium.

For the subscription to the Salon d’écoute: access is opened upon validation of the payment, for the subscribed period. The subscription renews automatically at expiry, for an equivalent period, unless cancelled by the customer before the end of the current period (see article 9.4).

For tickets or registrations for events: the order confirmation serves as proof of registration; additional information (venue, times, practical arrangements) may be sent by email.

Symphoniya cannot be held responsible if the customer provides an incorrect email address or does not check their messages.

8. Intellectual property and licence of use

All works, recordings, scores, videos, texts, images and, more generally, any content offered on the Site is protected by copyright and remains the exclusive property of its authors and rightsholders.

The purchase of a digital product or a score, like the subscription to the Salon d’écoute, grants the customer a strictly personal, non-exclusive and non-transferable right of use, for their private use.

The following are prohibited, in particular, unless prior written authorisation from Symphoniya: the reproduction, distribution or public provision of the works, in whole or in part, for commercial or promotional purposes; the sharing of purchased digital files with third parties; the unauthorised recording, capture or broadcast of concerts, events or workshops.

Any use beyond this scope must be the subject of a specific written agreement (for example for a public performance, an educational or professional use).

9. Right of withdrawal and refund policy

9.1. Downloadable digital content

By validating the purchase of downloadable digital content (audio file, video, score, document), the customer acknowledges that they obtain immediate access to the content and accepts that performance begins without delay. Consequently, and to the extent permitted by applicable mandatory law, the customer waives any right of withdrawal once the download of or access to the content has begun.

9.2. Events, concerts and workshops

Tickets or registrations for events (concerts, workshops, etc.) are, in principle, neither taken back nor exchanged. In the event of cancellation of the event by the organiser, the terms of refund or postponement will be communicated to the customer.

9.3. Physical products (where applicable)

If Symphoniya offers physical products (for example, CDs, printed scores), the conditions of return and refund will be specified on the product page and/or during the ordering process.

9.4. Subscription to the Salon d’écoute

The subscription to the Salon d’écoute may be cancelled at any time. Cancellation takes effect at the end of the current subscription period; sums paid for the period already started are not refunded, subject to applicable mandatory provisions. As this concerns access to digital content whose performance begins upon subscription, the customer is informed that the right of withdrawal does not apply once access has been opened, to the extent permitted by applicable mandatory law.

9.5. Particular requests

In the event of a proven technical problem (defective file, non-functional download link, interrupted access), Symphoniya undertakes to provide the customer, as far as possible, with a new link, a corrected file or the restoration of access. If this proves impossible, a refund may be considered on a case-by-case basis.

10. Donations and support contributions

The Site may offer the customer the opportunity to make donations or support contributions to the Association Culturelle Symphoniya. Unless explicitly stated otherwise, these donations do not give rise to the provision of any specific good or service in return. They are, in principle, neither refundable nor exchangeable. The customer is invited to check, where applicable, the conditions of any tax deductions directly with the competent tax authority.

11. Personal data

The personal data collected during the use of the Site or the placing of an order (surname, first name, contact details, email, billing data, etc.) is processed by Symphoniya in compliance with the applicable data protection legislation.

The purposes, the legal basis, the retention period and the customer’s rights regarding their data are described in the Privacy Policy. By placing an order, the customer declares that they have read it.

12. Liability

Symphoniya makes every effort to ensure access to the Site and the provision of products under the best conditions. Its liability cannot, however, be engaged in the event of: temporary interruptions of the Site for maintenance, updates or technical reasons; failure or malfunction attributable to the Internet network, access providers, or the customer’s hardware or software; loss of data or damage resulting from improper use of the downloaded content or the information provided.

In any event, Symphoniya’s liability is limited to the amount actually paid by the customer for the product concerned, unless mandatory provision to the contrary.

13. Force majeure

Symphoniya cannot be held responsible for any delay or non-performance resulting from a case of force majeure within the meaning of Swiss law, in particular in the event of unforeseeable and irresistible external events rendering the performance of the service impossible.

14. Amendment of the GTS

Symphoniya reserves the right to modify these GTS at any time. The applicable GTS are those in force at the time the customer places the order. Any new version will be put online on the Site with the update date.

15. Governing law and jurisdiction

These GTS are governed by Swiss substantive law, excluding its conflict-of-law rules.

The Association Culturelle Symphoniya has its seat in Les Charbonnières (Vallée de Joux, municipality of Le Lieu, district of Jura-Nord vaudois, Canton of Vaud).

In the event of a dispute and failing an amicable solution, the place of jurisdiction is at the seat of the Association; the materially competent courts of the district of Broye and Nord vaudois, in Yverdon-les-Bains (VD), have sole jurisdiction, subject to any mandatory provisions to the contrary, in particular in matters of consumer protection.
